Social Security to Refuse New Applications from Claimants with Pending Appeals

Implementing Social Security Ruling 11-1p, the Social Security Administration announced via Emergency Message last week that it would no longer accept new applications for disability benefits when a claimant has a pending appeal for the same title and same benefit pending at any level of appeal. This policy change, which is effective August 1, 2011,  is not applicable to appeals related to continuing disability reviews, age 18 re-determinations or cases pending in or remanded from federal court. For cases pending at the Appeals Council level, the Council has discretion to permit a field office to accept a new application if the claimant has evidence of a new disabling condition that arose after the administrative law judge hearing.
