Housing advocates and AG join forces against BIA suit

As reported in today’s Sacramento Bee, on January 12, the attorney general’s office joined in a motion filed by low-income residents and housing advocates to dispose of a lawsuit challenging Sacramento County’s affordable housing ordinance. The ordinance, adopted in December 2004, requires developers to set aside 15 percent of units for lower income households or to provide the equivalent in land or fees. The Building Industry Association of Superior California (BIA) subsequently sued the County in an effort to get the County to rescind the ordinance. Housing advocates and residents, represented by Legal Services of Northern California and co-counsel, and the state intervened to defend the ordinance. The Sacramento Bee has published editorials, most recently on December 23, critical of the BIA’s lawsuit in light of the 2300 affordable units in line to be developed as a result of the ordinance. The hearing on the pending motion is set for February 7 in Sacramento Superior Court.
